‘Contemporary Principles of Fatwa and the Methodology for Dealing with Unprecedented Minority Fiqh Issues’
The Imam Foundation for Training and Development, as part of its training courses for imams, organised a course on ‘Contemporary Principles of Fatwa and the Methodology for Dealing with Unprecedented Minority Fiqh Issues’ for imams and preachers from the Scandinavian countries. The course, delivered by Dr. Fadl Murad, spanned a total of 9 training hours.
The course covered the four stages of rooting: comprehensive grounding followed by partial grounding, semantic analysis, extraction, and consideration of rationales, higher objectives, and wisdoms. Dr. Murad also elucidated the original jurisprudential methodology, examining the approaches of the companions and successors. Dr. Fadl also explained the nature of the necessary principles in the jurisprudence of the present age, including the principles of conflicting interests, permissibility, necessity, facilitation and its six laws.
Additionally, Shaykh delved into the ten criteria for understanding emerging issues, encompassing conceptualising the true nature of the situation through questioning its essence, awareness of the practical judgments related to the emerging issue, considering the capacity and eligibility of the person involved, and examining the circumstances, motives, and intentions of the person seeking guidance. The course emphasised the importance of taking into account the context, the person's immediate and ultimate welfare, the scope of the fatwa in terms of generality, specificity, individual, and collective aspects, and the need for the insight of local jurists.
